Terms of Service

1. Acceptance of Terms

By accessing or using askthe.bot (the “Service”), you (“User”) agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms in their entirety, you may not access or use the Service. Your continued use of the Service constitutes ongoing acceptance of these Terms, including any modifications hereto.

2. Description of Service

The Service provides a software platform that enables Users to configure and deploy automated conversational agents (“Agents”) which generate responses using third-party large language models. The Service is a tool only; it does not exercise independent judgment, and any output produced by an Agent is generated programmatically without human review.

3. No Warranties; Service Provided “As Is”

THE SERVICE, INCLUDING ALL CONTENT, AGENT OUTPUT, FEATURES, AND FUNCTIONALITY, IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We make no representation or warranty that: (a) the Service will meet your requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) any output generated by an Agent will be accurate, complete, current, lawful, or reliable; (d) any defects or errors will be corrected; or (e) the Service or any servers used in connection therewith are free of viruses or other harmful components.

4. No Guarantees Regarding Agent Output

Agents generate responses using probabilistic language models and may produce output that is incorrect, incomplete, outdated, misleading, offensive, or otherwise unsuitable for any particular purpose. We do not guarantee, endorse, or assume responsibility for any statement, recommendation, advice, calculation, scheduling decision, or other output produced by any Agent. Users are solely responsible for evaluating the accuracy, appropriateness, and legality of any Agent output before relying on it.

5. User Responsibilities

You are solely responsible for: (a) all content, instructions, knowledge base materials, and configuration you provide to the Service (“User Content”); (b) the conduct of any Agent you configure; (c) ensuring that your use of the Service and your User Content comply with all applicable laws, regulations, and third-party rights; and (d) maintaining the confidentiality of your account credentials. You represent and warrant that you have all necessary rights to provide your User Content to the Service.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, OR OUR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100.00).

7. Indemnification

You agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) the operation of any Agent you configure; or (d) your violation of these Terms or any applicable law.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without notice or cause. Upon termination, all provisions of these Terms which by their nature should survive termination shall survive, including without limitation disclaimers, indemnities, and limitations of liability.

9. Modifications

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. Material changes will be reflected by updating the “Last updated” date above. Your continued use of the Service following any such modification constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the operator of the Service is established, without regard to its conflict-of-law provisions. Any dispute arising hereunder shall be resolved exclusively in the competent courts of that jurisdiction.

11. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior or contemporaneous communications, whether electronic, oral, or written.
